1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and SavePoint Pty Ltd ("SavePoint", "Company", "we", "us", or "our") regarding your use of the SavePoint Authentication Portal (auth.savepoint.com.au) and related authentication services ("Service"). By accessing or using our Service, you agree to be bound by these Terms.

2. Service Description

SavePoint Authentication Portal provides enterprise-grade Single Sign-On (SSO) authentication services, including:

  • Multi-factor authentication (MFA) and two-factor authentication (2FA)
  • Social login integration (GitHub, Google, etc.)
  • Passkey and WebAuthn support
  • Magic link authentication
  • OAuth 2.0 and OpenID Connect provider services
  • Enterprise user and access management

3. Account Registration and Eligibility

3.1 Eligibility

You must be at least 18 years old and have the legal capacity to enter into this agreement. Our services are intended for business and enterprise use.

3.2 Account Security

  • You are responsible for maintaining the security of your account credentials
  • You must use strong, unique passwords and enable multi-factor authentication
  • You must immediately notify us of any unauthorized access to your account
  • You are liable for all activities that occur under your account

4. Acceptable Use Policy

4.1 Permitted Use

You may use our Service only for lawful purposes and in accordance with these Terms. You agree to comply with all applicable laws and regulations.

4.2 Prohibited Activities

You agree not to:

  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Use the Service for any illegal or unauthorized purpose
  • Transmit viruses, malware, or other harmful code
  • Interfere with or disrupt the Service or its security features
  • Reverse engineer, decompile, or attempt to extract source code
  • Use automated tools to access the Service without permission
  • Share your account credentials with unauthorized parties

5. Security and Privacy

We implement enterprise-grade security measures to protect your data and maintain service integrity:

  • All data transmission is encrypted using industry-standard protocols
  • We do not use SMS-based authentication due to SS7 security vulnerabilities
  • All authentication events are logged for security and compliance purposes
  • We conduct regular security audits and vulnerability assessments
  • Your privacy is protected in accordance with our Privacy Policy

6. Service Availability and Support

6.1 Service Uptime

We strive to maintain high service availability but do not guarantee uninterrupted access. Scheduled maintenance will be announced in advance when possible.

6.2 Support

Technical support is available for enterprise customers. Support requests should be directed to support@savepoint.com.au with detailed information about the issue.

7. Intellectual Property Rights

7.1 SavePoint Property

The Service, including all software, documentation, and related materials, is the exclusive property of SavePoint and is protected by copyright, trademark, and other intellectual property laws.

7.2 User Data

You retain ownership of your data. By using our Service, you grant us a license to process your data solely for the purpose of providing authentication services.

8. Limitation of Liability

IMPORTANT: Please read this section carefully as it limits our liability.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SAVEPOINT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF THE SERVICE.

Our total liability for any claims related to the Service shall not exceed the amount paid by you for the Service in the twelve months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless SavePoint from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

10. Termination

10.1 Termination by You

You may terminate your account at any time by contacting us or using the account deletion feature in your dashboard.

10.2 Termination by SavePoint

We may suspend or terminate your access to the Service immediately if you violate these Terms or engage in prohibited activities.

10.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. We may retain certain information as required by law or for legitimate business purposes.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of Australia. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts in the relevant Australian jurisdiction where SavePoint Pty Ltd is registered.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by email or through the Service. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

14. Severability and Entire Agreement

If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and SavePoint regarding the Service.
